SQSHI operates this store and website, including the related information, content, products and services (the “Services”). Throughout these Terms of Service (“Terms”), the terms “we”, “us” and “our” refer to SQSHI. Our store is hosted by Shopify Inc., which provides the online platform that enables us to offer the Services to you.

These Terms apply to everyone who accesses or uses the Services, including visitors and customers. By accessing our website or placing an order, you agree to these Terms. If you do not agree, you should not access or use the Services.

Eligibility

To place an order, you must be at least the age of majority in your province, state or country of residence, or have permission from a parent or guardian who agrees to these Terms on your behalf.

Products and Product Information

Our squishies are novelty fidget toys recommended for individuals aged 14 and older. They are not suitable for young children. Certain products contain small parts, beads or other fillings that may present a choking hazard if the outer covering is damaged.

Our products are not food and must not be eaten, chewed or placed in the mouth. Food-themed designs are intended for visual purposes only. Some products may have a light scent when new that fades over time.

Products are manufactured in batches, and slight variations in colour, size, shape, scent, filling and slow-rise speed may occur. The appearance of colours may also vary depending on your device and display settings. Product descriptions and “squish stats” are provided as general guides to product characteristics and feel, rather than guarantees.

Prices and Payment

All prices are displayed in Canadian dollars (CAD), unless otherwise indicated. We may change product prices, availability or promotions at any time without notice. Price changes will not affect orders that have already been paid for.

Payments are processed through our payment providers. We do not store your full payment card details.

If a product is listed at an obviously incorrect price due to an error, we may cancel the affected order and issue a full refund.

Orders

We reserve the right to refuse or cancel an order, including where we reasonably suspect fraudulent activity, where an order is placed by a reseller or where an item is unavailable. If we cancel an order for which payment has already been received, we will issue a full refund.

Discount Codes and Promotions

Discount codes are subject to the conditions communicated when they are issued, including any restrictions on use per customer. Discount codes cannot be exchanged for cash or applied to previously placed orders and may be discontinued at any time.

We may cancel orders involving misuse of a discount code, including the creation of multiple accounts to bypass promotional restrictions.

Shipping

Shipping destinations, rates, processing times and estimated delivery times are described in our Shipping Policy, which forms part of these Terms.

Reviews and Submitted Content

If you submit a review, photograph, comment or other feedback through the Services or directly to us, you confirm that your submission reflects your honest opinion and does not violate applicable law or the rights of another person.

By submitting such content, you grant us permission to use, display and share it in connection with SQSHI. We reserve the right to remove submitted content at our discretion.

Intellectual Property

The SQSHI name, logo, product names, text, graphics and website design are owned by SQSHI or our licensors. You may not copy or reuse these materials without our prior written permission.

Third-Party Links and Services

The Services may contain links to websites or incorporate services operated by third parties. We are not responsible for the content, products or policies of those third parties.

Disclaimer

The Services and products are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we do not guarantee that the Services will be continuously available or free from errors, or that products will meet every individual expectation.

Nothing in these Terms excludes or restricts any rights or protections available to you under applicable consumer protection laws that cannot lawfully be excluded or restricted.

Limitation of Liability

To the fullest extent permitted by applicable law, SQSHI will not be liable for indirect, incidental or consequential losses arising from your use of the Services or our products. Subject to any rights or liabilities that cannot lawfully be limited, our total liability for a claim relating to an order will not exceed the amount you paid for that order.

Privacy

Our collection, use and disclosure of your personal information are described in our Privacy Policy.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in that province, subject to any mandatory protections available to you under applicable law.

Changes to These Terms

We may update these Terms from time to time. The latest version will be posted on this website, together with an updated “Last updated” date. Changes will take effect from the date they are posted, subject to any notice or other requirements under applicable law.
